Terms of Service

1. Acceptance of Terms
By accessing or using the BillaCrew platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. If you do not agree, you must not use the Service.
2. Service Description
BillaCrew provides an AI-powered customer engagement platform that includes configurable AI agents, multi-channel messaging, workflow automation, analytics, knowledge base management, and related tools. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. Free-tier users may experience feature limitations as described on our Pricing page.
3. User Responsibilities
When using the Service, you agree to:
- Provide accurate and complete registration information and keep it up to date.
- Maintain the confidentiality of your account credentials and notify us immediately of any unauthorised access.
- Not use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Not attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Not transmit any malicious code, spam, or harmful content through the Service.
- Not exceed the usage limits of your plan or circumvent any access restrictions.
- Comply with all applicable data protection laws when processing personal data of your end users through the Service.
4. Data Processing Agreement
Where you use the Service to process personal data of your end users, the following terms apply:
- You act as the Data Controller and BillaCrew acts as the Data Processor with respect to end-user data.
- We process end-user data solely on your documented instructions and for the purpose of providing the Service.
- We implement appropriate technical and organisational measures to protect personal data, including encryption, access controls, and regular security audits.
- We will notify you without undue delay (and within 72 hours) upon becoming aware of a personal data breach.
- We will assist you in fulfilling data subject access requests and other GDPR obligations.
- Upon termination of the Service, we will delete or return all end-user personal data within 30 days unless retention is required by law.
- Enterprise customers may request a dedicated Data Processing Agreement (DPA). Contact legal@billacrew.com.
5. Intellectual Property
The Service, including all software, designs, text, and trademarks, is owned by BillaCrew and protected by intellectual property laws. You retain ownership of all data and content you upload to the Service. By using the Service, you grant us a limited licence to process your content solely to provide and improve the Service. We do not use your data to train AI models for other customers.
6. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- BillaCrew shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- Our total aggregate liability under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
- Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
7. Termination
- You may terminate your account at any time from your account settings. Your access continues until the end of the current billing period.
- We may suspend or terminate your access if you violate these Terms, with notice where practicable.
- Upon termination, we will retain your data for 30 days to allow export, after which it will be permanently deleted unless required by law.
- Sections relating to intellectual property, limitation of liability, and dispute resolution survive termination.
8. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. For EU-based users, nothing in these Terms affects your rights under mandatory consumer protection laws in your jurisdiction. Any disputes shall first be addressed through good-faith negotiation, then mediation, and finally binding arbitration.
